GENERAL TERMS AND CONDITIONS (GTC)

§ 1 Scope

The following terms and conditions apply to all orders placed through our online shop. These terms and conditions are subject to change at any time. The version applicable to customers is always the one in effect at the time of the conclusion of the sales contract.

§ 2 Contractual Partners, Conclusion of Contract

The offers in our online shop are non-binding. By clicking the order button, you submit a binding offer to conclude a purchase agreement for the goods in your shopping cart. We will confirm receipt of your order immediately by email after you submit it. A binding contract is formed upon receipt of the order confirmation.

§ 3 Delivery conditions

Unless otherwise agreed with the customer, the shipping costs listed under "Delivery and Shipping Costs" apply. Delivery depends on the product and usually takes place within the number of days specified during the ordering process (under "Estimated Delivery Date"). Delivery is made to the address provided by the customer. If the ordered product, or part of an order, is not in stock, Cariba Swim will contact the customer. The shipping partner will be determined based on the warehouse location.

§ 4 Right of withdrawal

If the delivered goods are defective or if delivery is delayed by more than two weeks without prior notification to the customer, the customer has the right to withdraw from the purchase contract. The goods must be returned to Cariba Swim , and the customer bears the return shipping costs.

§ 5 Liability

All products distributed by Cariba Swim undergo rigorous quality controls conducted by Cariba Swim itself. As the design owner and responsible supplier of the products, Cariba Swim guarantees the quality and adherence to high standards for all products available in our online shop. The products are manufactured by a trusted producer in Portugal who adheres to our stringent requirements and specifications. Should any defects nevertheless occur, we are, of course, committed to providing a swift and satisfactory solution. Swiss law applies to international orders.

§ 6.1 Offer and Prices

All offers and prices on the website are non-binding and subject to change without notice. International customers may be subject to additional customs duties. Errors and changes to goods and prices are reserved.

§ 6.2 Gift vouchers

Gift vouchers can only be redeemed in the Cariba Swim online shop. Cash payment of the voucher value is not possible.

Gift vouchers are valid for three years from the date of purchase. After this period, any remaining balance will be forfeited without compensation.

Any remaining balance will not be paid out but will remain on the corresponding voucher code until its expiry date. Cash payment of the voucher value is also excluded if individual products, collections, or the entire product range are temporarily or permanently unavailable or if there is no longer any inventory.

Gift vouchers are transferable. Cariba Swim accepts no liability for loss, theft, or misuse of the voucher code.

§ 6.3 Cancellation and refund for digital gift vouchers

Gift vouchers are digital content that is made available to the buyer electronically after the order process has been completed.

Upon transmission of the voucher code, Cariba Swim's service is considered fully rendered. Cancellation of the purchase agreement and a refund of the purchase price are excluded after the voucher code has been delivered.

If the voucher code has not yet been redeemed and a verifiable technical error exists, Cariba Swim may, at its sole discretion, provide a replacement in the form of a new voucher code. Further claims for refunds are excluded to the extent permitted by law.

§ 7 Payment

Basically, we offer the payment methods credit card (Mastercard or VISA) , Apple Pay and Samsung Pay .

§ 8 Repayments

Any refunds will be processed to the account you specified for the refund. If you paid by credit card, the refund will be issued to the associated credit card account.

§ 9 Retention of title

The goods remain the property of Cariba Swim until full payment is received. Items are only sold in standard commercial quantities.

§ 10 External Links

Cariba Swim has no influence on the information and design of linked websites. Cariba Swim accepts no liability for incorrect information or illegal activities.

§ 11 Place of jurisdiction

The place of jurisdiction is the registered office of Cariba Swim in Aadorf, Switzerland .
